1. Acceptance of Terms

Welcome to The Incredible Bulk! By accessing or using our website, products, and services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

To use our Services, you must be at least 16 years old or the age of majority in your jurisdiction and capable of entering into a legally binding agreement. By using our Services, you represent and warrant that you meet these requirements.

3. Account Registration

To access certain features, you may be required to create an account. You agree to:

  • Provide accurate and complete information during registration.

  • Keep your account up-to-date.

  • Maintain the confidentiality of your login credentials.

  • Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.
NOTE: At this time, we do not offer services that require an account. This will change in the near future.

4. Use of Services

You agree to use our Services solely for personal, non-commercial purposes. You must not:

  • Copy, distribute, or disclose any part of our Services without written consent.

  • Interfere with or disrupt the Services or servers.

  • Use the Services for any unlawful or unauthorized purpose.

We reserve the right to modify or discontinue any part of the Services without notice.

5. Payments and Refunds

If you purchase any products or services through our site, you agree to pay the specified fees at the time of purchase. Refunds are only granted per our Refund Policy.

6. Intellectual Property

All content, materials, and intellectual property on our website and within our Services (including text, graphics, logos, images, and software) are owned by The Incredible Bulk or licensed to us. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal use only. You must not:

  • Modify, publish, or exploit any part of our intellectual property.

  • Remove or alter any copyright, trademark, or proprietary notices.

7. User-Generated Content

We may allow you to submit, post, or share content (e.g., testimonials, reviews). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and reproduce it as part of our Services. You represent and warrant that your content:

  • Is original and does not infringe on third-party rights.

  • Does not contain harmful, offensive, or illegal content.

We reserve the right to remove any content that violates these Terms.

8. Guarantees & Refund Policy

8.1. Free Training Guarantee

If you do not achieve your initial goal within the prescribed timeframe, we will provide continued training support for up to until your goal is reached.

Commitment to Your Success

At The Incredible Bulk, our top priority is your success. We are fully committed to providing you with the tools, guidance, and support necessary to help you achieve your goals. While we will do everything in our power to get you results or move you closer to them, individual outcomes will depend on factors outside of our control, including:

  • Your consistency – Adherence to the program, including training intensity, meal compliance, check-ins, bedtime, and recovery.

  • Your responsiveness – Engaging in communication, including responding to messages, attending 1-on-1 calls, and participating in group coaching.

  • Your health – Both mental and physical, which may impact progress.

  • Your individual genetics – Each person responds differently to training and nutrition.

These are factors that we cannot control. While we provide everything necessary for success, if you fail to meet the outlined requirements or do not adhere to the program as prescribed, we reserve the right to revoke the Free Training Guarantee.

To date, no participant has required extra time to see results. At The Incredible Bulk, exceptional results aren’t the goal they’re our standard.

To qualify, you must:

• Complete the full program as prescribed (including check-ins, calls, training, and meals).
• Follow the program with at least 90% adherence (tracked by The Incredible Bulk via weekly check-ins, progress photos, weight logs, etc.).
• Submit a request for continued training within 30 days of completing the program.

Exclusions:

• If you fail to complete the program requirements.
• If you fail to respond within 48 hours or stop responding to required check-ins, weigh-ins, or calls.
• If you withdraw for personal reasons unrelated to the program.

The final decision on eligibility is solely at the discretion of The Incredible Bulk.

8.2. 48-Hour “No-Sweat” Guarantee

If you decide within 48 hours of purchase that our program is not right for you, you may request a full refund.

To qualify, you must:

• Submit a refund request via email to (george@theincrediblebulk.ca) with the subject line: “Refund Request” within 48 hours of purchase.

• Not have accessed custom plans, training plans, meal plans.

• Not have received a 1:1 coaching call or attended a group call.

You will be granted your personal “Phase 1” video within 24 hours of joining The Incredible Bulk, regardless if you request a refund or not. That is guaranteed.

Refunds will be processed within 7 business days via the original payment method (Stripe, PayPal, or other methods).

8.3. Refund Restrictions

  • After 48 hours: Only 50% of the total purchase price is refundable.

  • After 7 days: No refunds will be issued under any circumstances.

  • All refund decisions are final and at the discretion of The Incredible Bulk.

8.4. Fraudulent Refund & Chargeback Policy

Chargebacks, unauthorized payment disputes, or refund requests based on third-party influence (such as competitors offering incentives to cancel this program) will be considered a violation of these Terms and may result in legal action.

Any chargeback filed after agreeing to these Terms will be contested with supporting documentation and may result in permanent removal from future services.

By purchasing our program, you agree to this Guarantee & Refund Policy.

9. Liability Waiver & Assumption of Risk

Strength training and physical exercise involve risks, including but not limited to muscle tears, fractures, spinal injuries, or other physical harm.

By using our program, you acknowledge that:
• The Incredible Bulk is not responsible for injuries, damages, or health complications.

• You have consulted with a physician and are medically cleared for exercise.

• You assume full responsibility for your participation and waive any legal claims against The Incredible Bulk.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Incredible Bulk from any claims, damages, liabilities, or legal fees arising from:

  • Your use or misuse of the Services.

  • Your violation of these Terms.

  • Your violation of third-party rights.

11. Termination of Service

We reserve the right to suspend or terminate your access to our Services if you:

  • Violate these Terms

  • Attempt refund fraud or chargebacks

  • Engage in behavior that is harmful to our community

If your access is terminated for violating these Terms, you will not be eligible for a refund.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada. Any disputes will be handled exclusively in Ontario courts.

13. Changes to the Terms

We may update these Terms periodically. Your continued use of our Services after changes means you accept the new Terms.
